Terms of Service

These Terms of Service (“Terms”) govern your access to and use of NeverForgetSocial (the “Service”), an autonomous content engine operated by InventiveHQ (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.

1. The Service

NeverForgetSocial researches, writes, schedules, and publishes social media content to third-party platforms on your behalf, including Twitter/X and Bluesky. You connect your own social accounts, and the Service posts to them according to the schedule and configuration you set.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Connected social accounts

  • You authorize the Service to access and post to the third-party accounts you connect, using the permissions you grant through each platform’s authorization flow.
  • You represent that you own, or are authorized to manage, every account and brand you connect.
  • Your use of each connected platform remains subject to that platform’s own terms. For Twitter/X, that includes the X Terms of Service and Developer Agreement and Policy. You agree not to use the Service in any way that would cause us or you to violate them.
  • You can disconnect an account or revoke our access at any time, from the Service settings or from the platform itself.

4. Your content

You retain ownership of the content you provide and of the content the Service generates for you. You grant us a limited license to store, process, and transmit that content solely to operate the Service on your behalf. You are solely responsible for the content published through your connected accounts, including content generated with our assistance, and for ensuring it is accurate, lawful, and not infringing.

5. Acceptable use

You agree not to use the Service to:

  • Post spam, malware, or unlawful, deceptive, or infringing content;
  • Harass, threaten, or harm others, or violate anyone’s privacy or rights;
  • Engage in platform manipulation, artificial amplification, or any activity prohibited by a connected platform;
  • Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its systems.

6. AI-generated content

The Service uses automated and AI systems to produce content. Such content may contain errors or inaccuracies. You are responsible for reviewing content before it is published and for the decision to publish it. You can configure approval steps in the Service to review drafts before they go out.

7. Fees

If the Service is offered on a paid basis, applicable fees and billing terms will be presented to you before purchase. Unless required by law, fees are non-refundable.

8. Third-party platforms & availability

The Service depends on third-party platforms and APIs that we do not control. Those platforms may change, restrict, or discontinue access at any time, which may affect the Service. We do not guarantee uninterrupted or error-free operation, and we are not responsible for the acts or omissions of third-party platforms.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required to protect the Service or other users. Upon termination, your right to use the Service ends.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, InventiveHQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $100.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be communicated where appropriate. Your continued use of the Service after changes take effect constitutes acceptance.
